Trademark Registration in Romania
Because Romania is an EU member, there are two routes here: a national OSIM registration or an EU trade mark covering 27 countries. Which suits you depends on whether you sell beyond Romania and on your budget. Let us weigh both together.

Step 1 / 2Two short steps. We do not ask for a passport or identity document at this stage.
Who needs a Romanian trademark registration?
For companies exporting from Türkiye, Romania is one of the most accessible entry points into the EU market.
Brands exporting to Romania
Manufacturers selling through a distributor or their own channel. A national registration is the step to take before any distribution agreement.
Companies with a Romanian entity
Businesses that have set up an SRL or opened into the EU through Romania. A company name gives no trademark protection; they are separate registers.
Manufacturing and sourcing
Brands producing under contract in Romania or sourcing from there. Registering where you manufacture reduces the risk of imitation from the outset.
E-commerce and marketplace sellers
Sellers on eMAG and other local marketplaces. Platform brand programmes generally require a national registration or an EU mark.
Food, cosmetics and textiles
Companies in the sectors where Romania is strongest. Sector density raises the risk of a similar mark already existing.
Planning regional expansion
Brands opening into the Balkans and Eastern Europe. A Romanian registration covers one country; for a regional plan, an EU mark or Madrid is considered.
A national OSIM registration or an EU trade mark?
This is where Romania differs: as an EU member it offers two valid routes, and the choice drives the budget directly.
Romania only
A filing with OSIM; protection stops at the Romanian border. Fees are markedly lower than for an EU trade mark.
27 countries in one filing
An EUIPO filing covers every EU member state including Romania. The fee is higher but the cost per country is far lower.
The unity principle
With an EU mark, an objection in a single member state can affect the whole application. A national registration carries no such risk; any problem stays confined to Romania.
Where do you sell?
If you sell only into Romania, a national registration is the economical choice. From two EU countries upwards, an EU mark is almost always the better fit.
Representation and correspondence
Applicants domiciled outside the EU face a representation requirement; this is not specific to Romania but applies across the EU.
Class plan and examination grounds
OSIM examines absolute grounds on its own motion; earlier rights come up through opposition instead.
Multi-class in one filing
Romania allows several classes in a single application, with fees calculated by class count. That is a clear simplification compared with the Gulf states.
Absolute grounds
Signs that lack distinctiveness, are descriptive or run against public policy can be refused by the office on its own motion. Checking the meaning in Romanian matters at this stage.
Meaning in Romanian
A Turkish or English word can be descriptive or carry a negative meaning in Romanian. A language check before filing is essential.
Earlier rights
OSIM does not raise earlier rights as a ground of refusal on its own motion; owners oppose after publication. That makes a pre-filing similarity search particularly important.
OSIM fees and costs that can arise later
In the table below, official fees and service fees sit on separate lines. Because the tariff is updated, we do not publish fixed amounts here.

Documents and information
The document set on a Romanian file is light; the real work sits in the national-versus-EU decision and the Romanian language check.
From filing to registration
Timelines depend on the office’s current workload and how the file develops; no fixed period is given on this page.
- 1Assessment and strategyWe review the mark and target goods and services, then settle the national-versus-EU question and the class plan.
- 2Search and language checkIdentical and similar signs are assessed and the meaning the mark carries in Romanian is checked.
- 3FilingThe file is submitted through the OSIM system and an application number issues. An application number is not a registration certificate.
- 4Formal and absolute grounds examinationThe office reviews formal requirements and absolute grounds. Where a deficiency or ground is notified, it must be answered in time.
- 5Publication and opposition windowThe application is published in the official bulletin and third parties may oppose within the period provided by law.
- 6RegistrationIf no opposition arrives, or it resolves in your favour, the registration and publication fee is paid and the certificate issues.
After registration: use, watching and renewal
A Romanian registration is also a right that needs managing.
Non-use risk
A mark not put to genuine use within five years of registration can be cancelled on a third party’s request. Evidence of use should be archived.
Watching
Monitoring similar applications is a separate service. Because OSIM does not examine earlier rights on its own motion, watching matters especially here.
Renewal
Protection renews in ten-year periods and the renewal fee is calculated by class count.
Keeping the register current
Changes of name, address and ownership must be recorded.
